CYGNVS Inc. and its affiliates (“CYGNVS” or "Company" or "We") respect your privacy and are committed to protecting it through our compliance with this policy.
This policy describes the types of personal data we may collect from you or that you may provide when you visit the CYGNVS websites (the “Website”) or access or use our Services, Applications and Reporting Analytics (collectively with the Website, the "Services") and our practices for collecting, using, maintaining, protecting, and disclosing that information. Please read this policy carefully. If you do not agree with our policies and practices, do not use our Services. By accessing or using the Website or Services or providing us with your personal information, you are consenting to this privacy policy. This policy may change from time to time, and your continued use of the Services is deemed to be acceptance of those changes, so please check the policy periodically for updates.
This policy applies to all personal data we collect.:
- On or through the Services including but not limited to email addresses, telephone number, IP addresses, cookies and usage details to enhance and improve your experience.
- Email, text, correspondence, surveys and other electronic messages between you and the Services.
- Through mobile and desktop applications you download from the Services or a third-party application store, which provide dedicated non-browser-based interaction between you and the Services and any applications or advertisement that link to this policy.
- Internet and network information such as the equipment you use to access our Services, usage details, browsing history, browser type and referring site.
- Financial-related information and billing and shipping address for purposes of billing your organization.
- Commercial information such as your purchasing history with respect to the Service on behalf of your organization.
- From third parties inviting you to use our Services.
Children Under the Age of 18
Our Services are NOT intended for children under 18 years of age. No one under age 18 may access or use the Services or provide any information to or on the Services.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- Details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services.

The Service may include social media features, such as the Twitter button, and widgets, such as the “share this” button or interactive mini-programs. These features may collect your IP address, which page you are visiting on the site, and may set a cookie to enable the feature to function properly. Your interactions with these features are governed by the privacy policy of the company providing the features.
The Company does not currently respond to any browser’s do not track signals.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:
- To present our Services and its contents to you;
- To provide you with information, products, or services that you request from us;
- To provide you with notices about your account including expiration and renewal;
- To notify you about changes to our Services or any products or services we offer or provide though it, including new products and services;
- To allow you to participate in interactive features and functionality on our Services;
- To perform the various functions for which your organization is using our Services;
- In any other way we may describe when you provide the information; or
- For any other purpose with your consent.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may disclose the following categories of personal information for a business purpose:
- Identifiers;
- Professional information;
- Internet and network information;
- Financial-related and commercial information;
- Third-party vendors who support our business and bound by contractual obligations;
- A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of CYGNVS’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding; and
- Other third-parties to fulfill a disclosed purpose for example, if you give us an email address to use the "email a friend" feature of our Services, we will transmit the contents of that email and your email address to the recipients.
We may also disclose your personal information:
- To comply with any court order, legal or government request;
- To enforce our agreements, including for billing and collection purposes; or
- To protect the rights, property, or safety of CYGNVS, our customers, or others.
We do not sell our users’ personal information.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. All data at rest on the Services or in transit to and from the Services is encrypted.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards. The information you share in public areas may be viewed by any user of the Services.
We are committed to taking appropriate measures designed to keep your personal information secure. Our technical, organizational and physical measures are designed to protect personal information from accidental, unlawful or unauthorized loss, access, disclosure, use, alteration, or destruction. While we make efforts to protect our information systems, no website, mobile application, computer system, or transmission of information over the internet or any other public network can be guaranteed to be 100% secure.
Data Retention
We will retain personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. We will retain personal information that we process on behalf of our end users for the duration set forth in the applicable contract with the business partner or as otherwise instructed by the business partner. Note your data and activity on the Services may not be deleted in certain cases since they are part of the record of your organization’s use of the Services which may be governed by laws and regulations driving your organization’s data retention requirements.
No Sensitive Information
We ask that you not send us, and do not share any sensitive information (for example, government-issued IDs, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, genetic, or biometric data, criminal background, trade union membership, or information relating to any individual’s sex life or sexual orientation), except where such information is legally required.
Accessing and Correcting Your Information
You can review and change your personal information by logging onto the Services and visiting your account profile page.
You may also send us an email at info@CYGNVS.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account (if you have an account with us). We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your account, your User Contributions on the Services are not deleted and will remain viewable since they are part of the record of your organization’s use of the Services which may be governed by laws and regulations driving your organization’s data retention requirements.
Opting Out of Marketing Messages from the Company
Users may receive marketing messages from us. You may opt-out from receiving electronic messages from us. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving these marketing related emails by contacting us at info@CYGNVS.com or by clicking on the opt-out link within the email message that you receive from us.
Opting Out of our cookies
You may disable cookies, including our cookies, by modifying the settings in your browser. However, please note that if you use our Services which requires you to be logged in, if you delete or disable cookies, you will not be able to stay logged in to the Services and, as a result, the Services will no longer be available to you. Our cookie is required to provide our logged in Services.
Note that if you delete cookies and you have previously opted out of interested based advertising from third parties, your opt out will be erased. You will need to exercise your opt out again. Opt out mechanisms are typically cookie-based.
California Privacy Rights
The California Consumer Privacy Act (CCPA) provides certain California residents with the additional rights listed below. Consistent with this policy, please do not share any sensitive personal information with us.
The following types of personal information may be temporarily exempt from the CCPA rights:
- Certain personal information reflecting a written or verbal business-to-business communication or transaction,
- Information about the Company’s employees, job applicants, contractors, controlling owners, directors, officers and medical staff (if any) in their capacities as such individuals at the Company.
Right to Access. The right to access is your right to request that we disclose information to you about our collection and use of your personal information over the past 12 months.
If we received your information from an end user, you will need to make the request directly with the end user unless the end user has authorized us to respond directly to you.
If we are permitted to respond to your request, once we receive and confirm your verifiable consumer request, we will disclose to you:
- The categories of personal information we collected about you,
- The categories of sources for that personal information,
- Our business or commercial purpose for collecting the personal information,
- The categories of third parties with whom we share the personal information, and
- The specific pieces of personal information we collected about you.
Data Portability Right. The data portability right is your right to request that we provide you with access to the information above (under Right to Access) in a format that allows you to transmit (i.e., port) the information to another entity. If you make an access request, you will automatically receive your information in a useable format.
Right to Delete. The deletion right is your right to request that we delete any of your personal information that we collected from you and still retain, unless an exception applies. Note your data and activity on the Services may not be deleted in certain cases since they are part of the record of your organization’s use of the Services which may be governed by laws and regulations driving your organization’s data retention requirements. Please contact your organization for more details on their data retention policies and the deletion of your user data and activity.
If we received your information from an end user, you will need to make the request directly with the end user.
If we are permitted to respond to your request, once we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies.
For data that our end users retain on you, you need to contact them directly to make a deletion request.
In some cases, we will deny a deletion request or not delete all of the personal information.
We may need to retain the personal information to:
- Complete a transaction such as a purchase of our Services, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or perform our contract with your organization.
- Protect against malicious, deceptive, fraudulent, or illegal activity or security incidents.
- Perform product debugging activities.
- Exercise a right provided by law, including ensuring the right of another consumer to exercise their free speech rights.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
- Engage in peer-reviewed or public scientific, historical, or statistical research in the public interest that complies with all other ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your organization’s relationship with us.
- Comply with a legal obligation.
- Make other lawful uses of that information that are compatible with the context in which we collected the information.
We may also limit our deletion to the extent permitted by applicable law.
Exercising Your CCPA Rights. You may exercise your California rights in the following ways:

We will try to respond to a request for access or deletion within 45 days of receiving that request. If we need more time, we will inform you of the reason and extension period.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
Non-Discrimination. The Company will not discriminate against you for exercising your CCPA rights. Unless allowed by the CCPA, we will not deny you any goods or services or charge you different rates, or provide you a different quality of goods or services or suggest a different rate or quality.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. We currently do not provide any financial incentives.
Rights of Certain European Data Subjects
This section applies if you are a data subject in the European Economic Area (which includes member states in the European Union), Switzerland or the United Kingdom.
Data Processor: We are primarily a data processor. We are a data processor with respect to the personal data collected or received by us when we receive such information from our end users which are the data controllers. Where we operate as a data processor, we are processing the data on behalf of our end users based on their instructions and our contracts with our business partners, and it is the responsibility of the end user to establish an appropriate legal basis for the processing of the personal data. For example, we may process personal data when the end user has provided us with consent for processing. On certain occasions we may rely on another legal basis for processing, such as when it is in our end users’ and our legitimate interests to do so and when these interests are not overridden by the individual’s data protection rights. Those legitimate interests include performing our obligations with respect to providing the Services to our business partners.
Data Controller: We are a data controller with respect to personal data collected or received by us when we receive personal data (such as name and email address) through our Website. For example, when you fill out a web form on the contact section of our Website, we receive that information as a data controller. In this case, the data controller is CYGNVS Inc. Where we operate as a data controller, we process personal information in light of our legitimate interests to provide the Website and for the adequate performance of the terms between us and our users. On certain occasions, we may also rely on the consent of the individual to process personal data.
Your Rights
Subject to applicable law, data subjects have the following rights:

International Transfers
The personal information we collect, is transferred to and maintained on servers or databases located in the United States, Germany, Japan and UK for internal processing, where the privacy laws may not be as protective as those in your location. Your use of the Services or your submission of your information to us represents your consent to such transfer, storage and processing outside of your country of residence (including transfers to the United States, Canada, Ireland and India where we operate and at our server locations referenced above), which may have different data protection rules than those of your country of residence.
In order to provide adequate protection for the transfer of personal information outside of the European Economic Area, the United Kingdom and Switzerland to the United States, we ensure that appropriate protections are in place. For example, to ensure that personal data is adequately protected when transferred outside of the European Economic Area, the United Kingdom and Switzerland, we rely on and comply with the “model clauses” or “standard contractual clauses” and applicable addenda (the “Model Clauses”). If there is any conflict between the terms in this Privacy Policy and the Model Clauses with respect to such transfer of personal information, the Model Clauses shall govern.
